One of the scariest moments of being in financial distress is getting sued… now the big bad, intimidating attorneys are after you. The absolute first thing you should do is consult a bankruptcy attorney. The first thing I will do to analyze your situation and determine if bankruptcy is the intelligent strategy to employ.
And bankruptcy is the right thing to do, unlike most attorneys I know, will actually reach out to the attorney suing you. Contrary to popular perception, I do not have a bad relationship with these attorneys. Its actually quite good and because I have collections experience (Yes, I was once on the dark side), I know how to speak their language and know their playbook. In fact, I know many, if not most of the major players in town, and when I call to tell them a client of mine, who is also is someone they are suing, is filing bankruptcy they do not get angry. Quite the contrary. They usually express appreciation at my professional courtesy ( I just saved them a lot if time) and they usually give me plenty of time to get you filed…. So even though you got sued, you can rest easy. And if you already getting garnished, sometimes I can help with that, too.
But beware…trying this yourself is not likely to work. So many people try this, it falls under the Little Boy Who Cried Wolf…they simply won’t give it in any credence. Plus, unless you are an attorney, you are likely to speak to an attorney.
